The petitioner, who was arrested and remanded to judicial custody on 31.07.2025, for the alleged offence punishable under Sections 5(1), 5(j), (ii) read with Section 6 of POCSO Act, 2012, under Sections 4(1), 5(1)(a), 5(1)(b), 5(1)(c) of Immoral Traffic ( Prevention) Act & Section 98 of BNS in Crime No.47 of 2025, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had committed forcible penetrative sexual assault against the victim minor girl. Hence, the case.
3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and opposed for grant of bail to the petitioner.
5.Considering the gravity of the offence committed by the petitioner, 2/4
this Court is not inclined to grant bail to the petitioner.
