O R D E R

The petitioner, who was arrested and remanded to judicial custody on 18.05.2025 by the respondent police in connection with Crime No.22 of 2025 for the offences punishable under Sections 87, 64(2)(m) of BNS and Sections 5(1), 5(j)(ii), 6(1) of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act), seeks bail. 2.The case of the prosecution is that the petitioner and the victim girl belong to the same village. It is alleged that the petitioner gave assurance to the victim girl and had committed aggravated penetrative sexual assault, due to which the 17 year old victim became pregnant. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner has been in custody since 18.05.2025, and the case is already pending for trial in S.C.No.187 of 2025 on the file of the Special Court (POCSO Cases), Tiruvannamalai. He further submitted that the petitioner has no connection with the alleged offence and therefore prayed for the grant of bail.

4.The learned Government Advocate (Crl.side) submitted that the petitioner was arrested on 18.05.2025 and final report has also been filed. Now the DNA sample has been sent for analysis. He further submitted that the victim girl has delivered a child and the DNA report is still pending.

5. Considering the manner in which the petitioner is alleged to have sexually assaulted the victim girl and the fact that the DNA report is awaited, this Court is not inclined to grant bail to the petitioner at this stage.
