O R D E R

The petitioner, who was arrested and remanded to judicial custody on 16.08.2025 for the alleged offence under Section 318(4) and 351(2) of BNS, 2023 in Crime No.423 of 2025 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joined hands with other accused collected huge money from various persons under the guise of conducting chit fund and subsequently cheated to the tune of Rs.8,70,000/- and abused him and also threatened him with dire consequences. Hence, the complaint has been registered.

3. The learned counsel for the petitioner submitted that the petitioner was arrested on 16.08.2025 and the chit fund was administered by the other accused, not this petitioner. He further submitted that he is ready to deposit amount as ordered by this court and also he is ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and reported that totally there are two accused in this case and that the petitioner is ranked as A2 and money involved in this case to the tune of Rs.8,70,000/- and so far, no amount has been recovered from them and the other accused also absconded. Hence, he oppose to grant bail to the petitioner.

5. Considering the fact that the main accused in this case (A1) is absconding and huge amount of Rs.8,70,000/- has been cheated by the petitioner and so far, no amount is recovered from him, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. 08.10.2025 ssi To:
