This petition has been filed to condone the delay of 1160 days in re-presenting the second appeal.

2. The learned counsel for the petitioners filed a memo dated 06.03.2026 stating that the 3rd respondent died leaving behind the R1 and R2 as her legal representatives.

3. Since the legal representatives of the deceased 3rd respondent are already on record as R1 and R2, there is no abatement of second appeal due to the death of 3rd respondent.

4. Memo filed by the learned counsel for the petitioner is recorded.

5. Being satisfied with the reasons assigned in the affidavit filed in support of the petition, the delay of 1160 days in re-presenting the second appeal is condoned.

6. The Registry is directed to carry out necessary amendment in the appeal papers as well as in CMP, recording R1 and R2 are LRs of deceased R3. The Registry is further directed to number the second appeal, if it is otherwise in order and list the same for admission, after making necessary amendment. 06.03.2026.
