O R D E R

The petitioner, who was arrested and remanded to judicial custody on 13.09.2025 for the alleged offence under Section 420, 114, 120B of IPC in Crime No.14 of 2024 on the file of the respondent police, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joined hands with other accused threatened the defacto complainant to sell iridium and collected a sum of Rs.25 lakhs from him and thereby cheated the defacto complainant. Hence, the complaint has been registered.

3. The learned counsel for the petitioner submitted that in this case two other accused person viz., A1 and A2 already arrested and subsequently, they were released on bail and that the petitioner is only ranked as A4. He further submitted that he is ready to deposit the entire cheated amount and also he is ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and reported that this petitioner is a habitual offender and in this case, the petitioner received a total sum of Rs.7 lakhs from the defacto complainant and an other case in Crime No.16 of 2023 pending on the file of the District Crime Branch, Coimbatore which involved the total amount of Rs.4.5 Crores and so far, no amount has been recovered. Hence, he oppose to grant bail to the petitioner. 2/4

Considering the fact that the petitioner has fraudulently obtained a huge sum of Rs.7 lakhs from the defacto complainant and so far no amount has been recovered and also the fact that the petitioner is a habitual offender and he is in custody from 13.09.2025, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the Criminal Original Petition stands dismissed. 08.10.2025 ssi To:
