According to the applicant/plaintiff, the respondents/defendants have committed the act of infringement of trade mark, passing off and infringement of copy right. According to the applicant/plaintiff, the infringed products are being sold in Chennai within the jurisdiction of this Court. Invoices have also been filed along with the plaint to show that the products are being sold by the defendants in Chennai. The applicant/plaintiff is also having its office at Chennai. Since part of the cause of action has arisen within the jurisdiction of this Court, this Court is of the view that leave as prayed for in this application has to be granted. Accordingly, this application is allowed as prayed for.
