ORDER

Heard.

1. This Transfer Civil Miscellaneous Petition is filed seeking withdrawal of H.M.O.P. No.496 of 2024 from the file of the Family Court, Trichy and transfer of the same to the file of the Family Court, Coimbatore.

2. The petitioner is the wife. It is stated that the marriage between the petitioner and the respondent was solemnized on 03.03.2014 as per Hindu rites. The respondent has instituted H.M.O.P. No.496 of 2024 before the Family Court, Trichy.

3. The petitioner contends that she is residing at Coimbatore with her parents and that she has to travel more than 220 kms from Coimbatore to Trichy to attend every hearing, causing hardship and difficulty.

4. In matrimonial matters, the convenience of the wife, particularly when she is residing away from the place where the proceedings are instituted and is required to undertake repeated travel, is a relevant and weighty circumstance. The pleadings indicate that the petitioner is residing at Coimbatore and the journey to Trichy is stated to be long and onerous, this Court is satisfied that continuance of the proceedings at Trichy would cause avoidable hardship to the petitioner, whereas transfer to Coimbatore would subserve the ends of justice. No serious prejudice is shown to be caused to 2/4

the respondent by such transfer.

5. Accordingly, Tr.C.M.P. No.1383 of 2024 is allowed. H.M.O.P. No.496 of 2024 on the file of the Family Court, Trichy, is withdrawn and transferred to the file of the Family Court, Coimbatore. The Family Court, Trichy, shall transmit the entire records to the Family Court, Coimbatore, within three (3) weeks from the date of receipt of this order and the Family Court, Coimbatore shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. Interim stay granted by this Court on 03.01.2025 shall stand vacated and C.M.P. No.29742 of 2024 is closed. There shall be no order as to costs. 12.01.2026 Index:Yes/No Internet:Yes dsn 3/4
