O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 296(b), 115(2), 109, 351(3) of BNS @ 191(2), 191(3), 296(b), 115(2), 109, 351(3) of BNS, 2023 in Crime No.466 of 2025, on the file of the respondent police, seeks anticipatory bail. 1/4

2. The allegation against the petitioner is that due to previous enmity, the petitioner joined hands with other accused abused the defacto complainant with filthy language and assaulted him and also criminally intimidated him and caused injury. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the other accused used the weapon and this petitioner has no role in this occurrence. He further submitted that he is ready to co-operate for investigation. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and reported that the petitioner is a habitual offender and he is having three previous cases due to previous enmity, the petitioner and others abused and attacked the defacto complainant and caused injury. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and taking note of the submission made by the learned Government Advocate (Crl.Side), the 2/4

nature of allegation and his previous bad antecedents and also considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
