The petitioners, who apprehend arrest for the alleged offence under Sections 85 of BNS (498-A of IPC) in Cr.No.26 of 2025 on the file of the respondent police seeks anticipatory bail.
2. When the matter is called today, the learned Government Advocate (Crl.Side) reported that now, the respondent police has conducted investigation and altered the offences from Section 85 BNS to Section 85 BNS and Section 3(1)(s) of SC/ST(POA) Act 1989. He further submitted that in view of the bar contained under Section 81(a) of SC/ST Act, this petition is not maintainable.
3. I have gone through the alteration report and it is found that the allegations make out the offense under Section SC/ST Act. In view of the bar contained under Section 18(a) of SC/ST Act, I am not inclined to grant anticipatory bail to the petitioner.
4. Accordingly, this Criminal Original Petition is dismissed. 10.10.2025 Vv To 2/4
