Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondents herein to remove the shelter (Nizhal Kudai) erected directly in front of the petitioner's shops situated at Survey no.7A/7, measuring 0.63 hectares, in Ulugalappadi Village, Sankarapuram Taluk, Kallakurichi District based on the petitioner's representation dated 25.09.2025 to the respondent within the stipulated time fixed by this Hon'ble Court. ORDER

The writ petitioner seeks issuance of writ of Mandamus, seeking direction to the respondents to remove the shelter (Nizhal Kudai) in favour of the petitioner's shop at Ulugalappadi Village, Sankarapuram Taluk, Kallakurichi District.

2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

3. The petitioner has given a representation dated 25.09.2025 and seeks disposal of the said representation.

The learned Government Advocate appearing for the respondents states that the petitioner is an encroacher and is occupying Government land and the shelter (Nizhal Kudai) has also been put up only in the Government land. However, the said representation is based on written instructions received by the learned Government Advocate. It would suffice to direct the respondents to dispose of the petitioner's representation dated 25.09.2025 on merits and in accordance with law within a period of four (4) weeks from the date of receipt of a copy of this order.

5. In fine, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
