This Civil Miscellaneous Petition has been filed to condone the delay of 785 days in filing the above appeal.
2. Heard the learned counsel for the petitioners.
3. The learned counsel for the second respondent has got objections in allowing the petition, by stating that the petitioners are not entitled for the interest for the delay period.
4. The 1st petitioner would aver that owing to the sudden death of her husband, who was the sole breadwinner of the family, she has been struggling to take care of their needs and due to financial constrains, delay of 785 days occurred in preferring this appeal.
5. The reasons assigned by the petitioners appears to be acceptable. Hence, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 785 days shall stand waived.
