PRAYER : Criminal Original Petition filed under Section 482 of BNSS, to pass an order of to enlarge the petitioner on bail in the event of his arrest in Cr.No.258 of 2021 pending investigation on the file of the respondent police.

O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for offences punishable under Sections 406, 420 and 506(1) of Indian Penal Code, in Crime No.251 of 2022, on the file of the respondent police, and therefore seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, in collusion with others, collected a sum of Rs.4,00,000/- for the purpose of conducting a chit fund and subsequently failed to repay the same. Hence, the present case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is ranked as A2 and that he has been falsely implicated in this case. Hence, he prays for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the investigation has been completed and the final report has also been filed. Cognizance has been taken in C.C. No. 324 of 2025 on the file of the Judicial Magistrate, Cholavaram. It is further stated that only summons have been issued for the appearance of the petitioner herein. He therefore opposed the grant of anticipatory bail to the petitioner.

5. Considering the fact that only the trial court has issued summons to the petitioner herein, and that there is no apprehension of arrest at this stage, I am not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
