O R D E R

The petitioner, who was arrested and remanded to judicial custody on 15.09.2025 for the alleged offence under Sections 123 of BNS and Section 22(a) of Cigarette and other Tobacco Products Acts 2003 in Crime No.571 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in 1/4

possession of 7.900 kgs of prohibited tobacco products in order to sell the same to general public for his personal gain. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in prison from 15.09.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner is having ten previous cases, out of which eight cases are similar in nature. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the overall facts and circumstances of the case that 2/4

the petitioner was arrested recently and the petitioner is having ten previous cases, I am not inclined to grant bail to this petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 08.10.2025 Vv To
