Common Prayer:- These writ petitions are filed under Article 226 of the Constitution of India, to issue a writ of declaration, declaring the tender notification dated 13.08.2025 issued by the 3rd respondent and the consequential resolution of the 3rd respondent council dated 09.09.2025 insofar as it pertains to resolutions Nos.1 to 7 pertaining to allotment of shops in Blocks A to G of the Mannargudi New Bus Stand, as arbitrary, illegal, unconstitutional and direct the respondents to conduct the open auction tender for the new shops in the Mannargudi bus stand in a fair and transparent manner in accordance with law. For Petitioner : Mr.S.Ramesh (in all W.Ps) For Respondents : Mr.P.S.Raman, AG Asst. by Mr.P.Anandakumar, GA (R3) Mr.L.S.M.Hasan Fizal (R1&R2) (in all W.Ps) C O M M O N O R D E R These writ petitions challenge the auction for newly constructed shops in Kamarajar Bus-stand, Mannarkudi.
2. When these matters came up for hearing on 23.01.2026, the Hon'ble Advocate General reported that out of the total number of shops, which was brought for auction in Phase-I, 9 shops continue to remain vacant. In addition, he pointed out that in Phase-II, none of the shops have been auctioned.
3. The number of petitioners impugning the auction are four in number. That being the situation, I called Mr.S.Ramesh to get instructions from his clients to identify the shops and file affidavit(s) of the petitioners. Hence, I posted these matters today(27.01.2026).
4. When I took up these matters for today(27.01.2026), Mr.S.Ramesh has filed a memo of petitioners identifying the shops and also expressed the agreement that the petitioners are willing to shops, which were identified on their same terms, as allotted to the other shop owners on 03.09.2025.
5. The Commissioner of Mannarkudi Municipality is present before this Court. He has also made an endorsement to that effect on the memo dated 27.01.2026, stating that he is agreeable to the said terms. Mr.Anand Kumar appearing for Commissioner, has also made an endorsement on the memo. The memo is scanned and extracted hereunder:-
6. As the lis has been settled to the agreement of both parties, nothing further remains other than recording the memo and disposing the writ petition.
