Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 2nd respondent to take immediate action on petitioner application dated 07.11.2024 (Application No.2024/0105/18/422112) and issue a separate patta in petitioner name for the 0.12 cents of land.

This Writ Petition is filed to direct the second respondent to take immediate action on petitioner application dated 07.11.2024 (Application No.2024/0105/18/422112) and issue a separate patta in the name of the petitioner for 0.12 cents of land.

2.The petitioner submitted that he acquired the property from one Mayavel's wife Nallammal and her heirs on 23.06.2020 under the registered Sale Deed vide Document No.908/2020. The petitioner seeks to subdivide 0.12 cents of land and submitted an online application (Application No.2024/0105/18/422112) on 07.11.2024 to issue a separate patta in his name for 0.12 cents of land. Since there is no response, the petitioner is before this Court.

3.Heard the learned counsels on the either side and perused the records.

4.Considering the facts and circumstances of the case, the respondent is directed to conduct an enquiry of the subject property. The petitioner shall submit all the relevant records to show his title to the property and the respondent shall, after issuing notice to the interested parties, hold an enquiry and thereafter, proceed to pass orders either issuing a separate patta or rejecting the request. In the case of a rejection, a speaking order shall be passed. The said exercise shall be completed within a period of 3 months from the date of receipt of a copy of this order. 5.The Writ Petition is allowed. No costs.
