The Writ Petition (Criminal) has been filed seeking a direction to the respondents to withdraw the Look Out Circular (LOC) pending against the petitioner.

2. Heard both sides and perused the materials available on record.

The main grievance of the petitioner is that the complaints containing similar allegations lodged, earlier before the Commissioner of Police, Vepery and the Superintendent of Police, Thiruvallur, had already been closed in the year 2018 on the ground that the allegations are civil in nature. However, after the lapse of several years, a fresh complaint with similar allegations has been lodged against the petitioner before the second respondent herein, pursuant to which, a case in Crime N.96 of 2025 was registered for the offence under Sections 406, 420, 465, 468, 471 & 506 (1) of IPC on the file of the second respondent Police. Based on the said First Information Report, a Look Out Circular (LOC) has been issued against the petitioner. Hence, the present petition has been filed.
4. Learned Additional Public Prosecutor, on instructions, submitted that notice under Section 41A Cr.P.C. (corresponding to Section 35(3) of BNSS) was earlier issued to the petitioner in connection with the present case, however, the petitioner did not appear before the respondent Police for enquiry.

5. In view of the above, the respondent Police are directed to issue a fresh notice to the petitioner under Section 35(3) of BNSS, calling upon him to appear for enquiry. On receipt of such notice, the petitioner shall appear before the respondent Police, produce the relevant documents and proof relating to the closure of the earlier complaints with similar allegations before the competent authorities. On such appearance of the petitioner and production of necessary documents, the respondent Police shall issue appropriate instructions to the authorities concerned to with draw the Look Out Circular pending against the petitioner.
6. Accordingly, this Writ Petition (Criminal) stands disposed of with the above directions. No costs.
