ORDER

The petitioner seeks issuance of writ of mandamus to direct the first respondent to consider the protest petition submitted through her counsel on 24.09.2025 and also to desist from accepting any documents from the second respondent or any person claiming under or through the second respondent.

2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the first respondent.

The learned Government Advocate appearing for the first respondent states that this Court in an identical circumstance by order dated 16.09.2025 in W.P.No.34521 of 2025 has directed an enquiry be conducted by the official respondents after issuing notice and giving an opportunity of personal hearing to the petitioner as well as to the applicant who proposes to register the documents and thereafter pass appropriate orders on merits and in accordance with law.

4. The learned Government Advocate on instructions would submit that the first respondent has no objection in any similar orders being passed in this 2/5

petition.

5. In the said case, the petitioner's protest petition was filed before the Registering Authorities and in the present case as well, the petitioner has submitted the protest petition on 24.09.2025. By relying on the decision of this Court in W.P.No..34521 of 2025, I am inclined to dispose of the present writ petition, directing the first respondent to conduct an enquiry after giving an opportunity by way of personal hearing to the writ petitioner and also to the applicant who submits the documents for registering the subject property and pass orders on merits and in accordance with law, as and when any such application is presented before him.

6. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
