PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the Respondent to consider the representation dated 06.12.2024 and disburse the subsistence allowance for the period of 31.08.2024 till the date ( Subsistence Allowance Rs.22,400/- per month Twenty Thousand Four Hundred Only) and appeal period and pass orders.

ORDER

By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.

2. This petition is filed seeking to issue a Writ of Mandamus directing the Respondent to consider the representation dated 06.12.2024 and disburse the subsistence allowance for the period of 31.08.2024 till the date ( Subsistence Allowance Rs.22,400/- per month Twenty Thousand Four Hundred Only) and appeal period and pass orders.

3. The facts of the case is that the petitioner is a employee of the respondent Corporation and he was issued with a charge memo on 26.11.2024 by the respondent. The grievance of the petitioner is that till date no subsistence allowance was paid to the petitioner, due to which he has given a representation to the respondent on 06.12.2024 and the same was not considered. Hence, this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the respondent to 2/4

consider the petitioner's representation and pass orders.

5. The learned Special Government Pleader appearing for the respondents submitted that they will consider the case of the petitioner conclude the enquiry as early as possible .

6. Heard both sides and perused the materials available on record.

7. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court directs the respondents to consider the representation of the petitioner and pay the subsistence allowance to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

8. With the above observations this writ petition stands disposed of. No order as to costs.
