For Petitioner : M/s.M.Velmurugan For Respondents : Mr.T.Sai Krishna Bhagavat, Standing counsel for R.1 & R.2.

O R D E R

This Writ Petition is filed for a direction directing the respondents to receive and process the application of the petitioner in Roll No.20639177 in the respondent's official website/ portal and permit the petitioner to write the main examination 2026 for the subject of Biology theory paper (Subject Code- 044) to be conducted by the CBSE.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had studied in Velammal International School Panchetti Thiruvallur during the academic year 2024. He had appeared for Board examination of class 12 (First Group comprised of Bio-Maths). Though he passed subjects such as English Core, Chemistry, Physics, Mathematics and Physical Education, he failed in the subject of Biology. Therefore, he was declared to repeat the theory with a grade E for the subject Biology by the respondents.

2/7

4. Thereafter, the petitioner applied and appeared for the supplementary examination in the year 2024 for the Biology subject. Unfortunately, he failed again and was directed to repeat the Biology Theory Paper. Once again, he applied through online portal of the respondents for the supplementary examination during the year 2025 in order to write the theory paper of the Biology subject. However, it was not accepted and as such the petitioner approached the 1st respondent and submitted a representation dated 05.06.2025. The said representation was not considered and as such the petitioner approached this Court. This Court in WP.No.21502 of 2025 issued interim directions to consider the petitioner's application in physical form for the Biology Supplementary Examination. However, time lapsed and as such the Writ Petition was withdrawn on 04.

09.2025. In order to appear for the supplementary examination in Biology subject scheduled in March 2026, the petitioner submitted his application through the respondents' online portal. However, the portal did not accept his application on the ground that "no records found". Hence, the Writ Petition.

5. The learned counsel for the respondents submitted that the petitioner had opted for Biology only as an additional subject. The 3/7

petitioner had chosen five core subjects such as English, Physics, Chemistry, Mathematics, and Physical Education and successfully passed the Higher Secondary Examination in all of them, except Biology. Since Biology was selected only as an additional subject, the petitioner is not required to pass that paper. However, he was permitted to write additional paper only for improvement. That apart, the petitioner is permitted to write the supplementary exam only for 2 years from the date of completion of his course. Admittedly the petitioner had completed his Higher Secondary Course in the academic year 2024 and he can write supplementary exam till 2026. Only because the petitioner failed to write the supplementary exam held in March 2025, the petitioner's application was not accepted by the respondent's portal for the reason "record not found".

6. Whether Biology is an additional subject or not, the petitioner has to pass the Biology subject in order to pursue any science-related course for his higher studies. Therefore, the petitioner may be permitted to write the supplementary examination for the subject of Biology (Subject Code 044) scheduled in March 2026.

7. In view of the above, the petitioner is directed to submit an 4/7

application through Physical mode to write supplementary examination for the subject Biology to the 1st respondent within a period of one week from today and the 1st respondent is directed to receive and process the said application to permit the petitioner to write the supplementary examination for the subject of Biology scheduled in March 2026.

8. With the above directions, the Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed. 08.10.2025 Index : Yes/No Speaking Order: Yes/No (shr) Note:- Issue order copy on 09.10.2025.
