ORDER

This Writ Petition has been filed seeking for issuance of a Mandamus, to direct the respondent to consider the petitioner's representation dated 01.09.2025 and to refer the petitioner to the Regional Medical Board for assessing his fitness and suitability for the post of Driver and to provide alternative light duty to the petitioner in the cadre equal to the post of Driver with pay protection, continuity of service and all other attendant benefits as per Section 20(4) of the Rights of Persons with Disabilities Act, 2016. 2.The case of the petitioner is that the petitioner was a Driver working in the respondent Corporation. However, in view of his physical disability, the petitioner has made a request for allotting him a different post since he is unable to effectively discharge his duties as a Driver. In view of his medical condition,

the petitioner has given a representation to the respondent on 01.09.2025 seeking reference to his case to the Regional Medical Board in order to accept fitness and suitability to the post of Driver and if it is found that the petitioner is unfit to the post of Driver, he may be provided alternative light duty depending on his medical condition.

3.The learned Standing counsel appearing for the respondent would submit that the respondent would pass suitable orders on the representation of the petitioner and also refer the petitioner's case to the Regional Medical Board for testing fitness and suitability of the petitioner in the meanwhile. 4.In view of the above, the respondent is directed to consider the representation of the petitioner dated 01.09.2025 and refer the petitioner to the Regional Medical Board for assessing his fitness and suitability for the post of Driver within a period of two weeks from the date of receipt of a copy of this order. Depending on the Certificate and report of the Regional Medical Board, the respondent shall pass final orders and dispose of the representation of the

petitioner dated 01.09.2025 within a period of six weeks from the date of receipt of the report of the Regional Medical Board. 5.With the above direction, this Writ Petition is disposed of. No costs. 03-10-2025 Dn Index:Yes/No
