The petitioners, who were arrested and remanded to judicial custody on 20.09.2025 for the alleged offence under Sections 123 of BNS and Section 7 and 20(1) of Cigarette and other Tobacco Products Acts 2003 in Crime No.386 of 2025 on the file of the respondent police, seek bail. 1/4

The case of the prosecution is that the petitioners joining hands with other accused had illegally transported 50.110 kgs of banned tobacco products, worth about Rs.19,820/- and 3.600 litres of Karnataka State Liquor, worth about 1,660/-, the same have been seized by the respondent police. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in prison from 20.09.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that totally there are three accused involved in this case and A3 is still absconding and investigation is pending. He further reported that there are no previous case as against the petitioners and they were arrested recently. Hence, he opposed to grant bail to the petitioners.

5. Heard both sides and perused the materials available on record.
6. Considering the fact that the petitioners were arrested recently, one of the accused is still absconding and the seized contraband is huge quantity, I am not inclined to grant bail to this petitioners.
7. Accordingly, this Criminal Original Petition is dismissed. 08.10.2025 Vv To
