O R D E R

The petitioner, who was arrested and remanded to judicial custody on 29.07.2025 for the alleged offence under Section 8(c) r/w 20(b)(ii)(C) of NDPS Act in Crime No.239 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 20 kgs of ganja for the purpose of selling to the public and the contraband was seized by the respondent police. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and reported that totally there are two accused in this case and that the petitioner is ranked as A1. He further submitted that the petitioner was arrested on 29.07.2025 and 20kgs of ganja which is commercial quantity was recovered from him hence rigor of Section 37 of NDPS Act would arise. He further submitted that co-accused (A2) is still absconding and investigation in this case is also pending. Hence, he oppose to grant bail to the petitioner.

Considering the above facts and circumstances of the case, the nature of allegation and the fact that investigation of this case is pending, and the coaccused still absconding, and also the fact that huge quantity of contraband involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
