Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 5 to prevent the 7th respondent from excavating/perform sand mining more than the sanctioned limit in Survey No.775/4, Sittheri, Periya Eari, Ullavur Village, Wallajapet Taluk, Kancheepuram District, pursuant to the order issued in Na.Ka.No.174/Q3/2024 dated 02.09.2025 who is selling the sand for commercial purpose.

ORDER
(Order of the Court was made by the Hon'ble Chief Justice) On the allegation of illegal quarrying operations being carried out by the 7th respondent, this Court appointed an Advocate Commissioner to examine the complaint and submit report.
2. The report of the Advocate Commissioner indicates that quarrying operations have been carried out beyond the permissible depths.
3. Learned State counsel, at this stage, would submit that on the basis of the report which has been submitted by the Advocate Commissioner, the authorities have now initiated proceedings against the 7th respondent, notice has been issued and reply has been obtained. He, further, submits that the competent authority shall consider the reply and also the material before it, including the report of the Advocate Commissioner, and shall take appropriate decision in accordance with law within a period of four weeks.
4. In view of the aforesaid submission, since proceedings have already been initiated by the authorities, we are not inclined to keep this petition pending, but to dispose it of.
Accordingly, this petition is disposed of. The Advocate Commissioner's remuneration, if not paid, shall be forthwith paid
within two weeks and recovered from the 7th respondent. There shall be no order as to costs.
