O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3 and 4 of the Tamil Nadu Public Property (Prevention of Damage & Loss) Act, 1992, in Crime No.488 of 2025, on the file of the respondent police, seeks anticipatory bail.

The case of the prosecution is that on 27.09.2025, during a political campaign at Namakkal, certain unknown persons allegedly entered the premises of Dr. Lakshmanan Multi Speciality Hospital and caused damage to the hospital property. The petitioner, being the District Secretary of Tamizhaga Vettri Kazhagam, is alleged to have failed to take necessary precautionary measures to prevent such untoward incidents. Hence, this case.

The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case; that the petitioner had never committed any offence as alleged by the prosecution; and that the petitioner is ready to produce
solvent sureties and to abide by any conditions that may be imposed by this Court and also undertake to appear and to co-operate for the investigation, and sought for anticipatory bail to the petitioner. 4.
The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and on instruction submitted that the petitioner is the District Secretary of Tamizhaga Vettri Kazhagam, Namakkal, he had obtained permission to conduct the party rally on the assurance that all the conditions imposed by the authorities would be complied with; however, the same was not followed. During the rally, the party cadres behaved in an unruly manner, resulting in damage to public and private property and the investigation is still in progress. It was further submitted that the petitioner, being a responsible person, had failed to exercise due control, and that as against the petitioner, eight (8) other First Information Reports have been registered for similar acts of causing damages to the public property. Hence, he opposed for the grant of anticipatory bail to the petitioner. 5.
Considering the fact that eight cases have already been registered against the petitioner for similar offences, and taking into
account the nature and gravity of allegations, this Court is of the view that the petitioner, being the person responsible for conducting political rally, had failed to take adequate precautions, which resulted in damage to the public properties. Since the investigation is still in progress, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

Accordingly, this Criminal Original Petition is dismissed. 03.10.2025 klt Note:-
