O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offence punishable under Section 66(D) of the Information Technology Act, 2000, and Sections 3(5), 318(2), 340(2), 62 of BNS Act, 2023, in Crime No.241 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with two other accused, promised to secure employment in JIPMER Hospital, Karaikal, and cheated several persons to the tune of Rs.12,00,000/-.

3. Learned counsel appearing for the petitioner submitted that the petitioner is arrayed as A3 and is not the main accused. It is further submitted that the petitioner's name has been misused by the other accused and that he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Additional Public Prosecutor appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is the 2/4

main accused. He had allegedly sent emails in the name of JIPMER to various persons, assuring them of getting employment as a Data Saving Junior Officer in JIPMER Hospital, Karaikal, and thereby collected a total amount of Rs.12,00,000/- from them. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

Considering the nature of the allegations, and the fact that it is case of job racketing, wherein the petitioner is alleged to have cheated several persons and misappropriated a sum of Rs.12,00,000/- under the pretext of securing employment in JIPMER Hospital, Karaikal, and also taking into account that some of the co-accused are still in custody and that custodial interrogation of the petitioner is necessary, this Court is not inclined to grant anticipatory bail to the petitioner.
