ORDER

Seeking a direction to the respondents to consider his representation dated 05.2.2024 to rectify the UDR patta so as to reflect the actual dimensions of the property measuring 1,386 sq.ft. in S.No.153/32, Pillaipakkam Village, Thiruperumbudur Taluk by conducting a proper field survey, the petitioner is before this Court.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader accepting notice for the respondents.

The case of the petitioner is that he acquired the subject property vide sale deed dated 23.12.1981 registered as doc.No.3340 of 1981 on the file of the Sub-Registrar, Sriperumbudur for a valid sale consideration and constructed a residential building over the same. During the year 1995, while updation of the registry, the Special Tahsildar, Natham Nilavari Thittam, Sriperumbudur issued a thoraya patta in favour of the petitioner in respect of 20.6 feet alone instead of 22 feet. Only in the recent past, the petitioner came to know about the wrong dimension. Hence, he made a representation dated 05.2.2024 to the first respondent seeking to rectify the dimensions in respect of the subject property by conducting a proper field survey. As the same 2/5

has not yet been considered, the petitioner has come forward with this writ petition.

4. It is nearly a year since the petitioner sent his representation dated 05.2.2024 to the first respondent. The authority concerned is the second respondent.

Considering the nature of relief sought, the writ petition is allowed and the petitioner is directed to forward a copy of the said representation dated 05.2.2024 to the second respondent within two weeks from the date of receipt of a copy of this order. On receipt of such a representation, the second respondent shall consider the said representation for rectification of the dimensions in the subject property on merits, conduct a survey, if necessary and pass appropriate orders within a period of six weeks there from.
