O R D E R
The petitioner, who was arrested and remanded to judicial custody on 08.09.2025 for the alleged offence under Sections 126(2), 296(b), 311, and 351(3) of BNS in Crime No.262 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner along with other 1/4
accused waylaid the defacto complainant, robbed a sum of Rs.500/- from him at knife point and also criminally intimidated him. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in prison from 08.09.2025. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner is having nine previous cases and he is also a History Sheeter vide H.S.No.8 of 2024. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the fact that the petitioner is having bad antecedents and he is having nine previous cases and he is also a history sheeter. Further, if the released on bail, he shall commit the same offence repeatedly, I am 2/4
not inclined to grant bail to this petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 08.10.2025 Vv To
