ORDER

This petition has been filed to enlarge the petitioner on bail in Spl.CC. No. 79 of 2022, on the file of II Additional District Judge/Special Judge of EC and NDPS Act, Salem.

2. The case of the prosecution is that the petitioner along with other accused persons have illegally transported 200 kgs of Ganja from Andhra Pradesh to Chennai through car bearing Registration No TN74 AM5159. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case as if he transported 200 kgs of Ganja. Further, the petitioner is in judicial custody for the past two years and nine months. In fact, the contraband involved in this case is 200 kgs of Ganja but as per the mahazar it is mentioned as 222 kgs. Furthermore, in another case 20 kgs of Ganja was seized from the petitioner along with other accused, in that case the petitioner was acquitted to that effect he produced the judgment of the Trial of Court. Hence, he prays to allow this petition.

4. Considering the facts of the case and also on perusal of the record, the petitioner acquitted in the case relating to crime No. 3 of 2022 and the contraband involved in that case is 20 kgs but in the present case contraband seized from the petitioner is 200 kgs of Ganja. Hence, this Court is not inclined to allow this petition. Accordingly, this petition is dismissed.
