O R D E R

The petitioner, who was arrested and remanded to judicial custody on 11.09.2025 for the alleged offence under Section 316(4) and 318(2) of BNS 2023 in Crime No.21 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that while the petitioner working as a collection agent of the defacto complainant's company, collected money 1/4

from various customers to the tune of Rs.14,75,274/- without crediting in the account, by issuing fake cheques and swindled the company funds. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not swindled any money and he has borrowed some amount from the defacto complainant's company. Since he was not able to repay the same, a false complaint had been lodged against him. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner is involved in misappropriation of funds, for which he was arrested on 11.09.2025. He further reported that no property has been recovered from the accused and investigation is still pending. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record. 2/4

6. Considering the fact that so far no amount has been recovered and the investigation is also pending, I am not inclined to grant bail to this petitioner

7. Accordingly, this Criminal Original Petition is dismissed. 08.10.2025 Vv To
