ORDER

This Writ Petition is filed seeking direction to the respondents 1, 2 and 3 to take action against the respondent 4 under Section 206 of the Tamilnadu Panchayat Act on the basis of petitioner representation letter dated 27.07.2024 within stipulated time.

Learned counsel for the petitioner submitted that the fourth respondent is the Panchayat Vice President of Kallapalayam Panchayat in Sulur Taluk of Coimbatore District and during his tenure as Panchayat Vice President, lot of misappropriation has been done by the him, therefore, the petitioner has submitted various complaints to the second respondent on 30.05.2022, 06.02.2023, 13.03.2023, 11.09.2023, 14.11.2023, 18.12.2023 and on 23.07.2024, he has also sent a representation to Chief Minister Camp. Finally, the petitioner has sent a representation dated 27.07.2024 to the respondents 1 to 3 requesting to take action against the fourth respondent, however, no action was taken, hence, the same has to be investigated by the Directorate of Vigilance and Anti Corruption and they have to be impleaded as a party in the present Writ Petition and prays for suitable directions.

3. The learned counsel for the Additional Government Pleader appearing for respondents 1, 2 & 3 have submitted that the term of the Vice President got over on 05.01.2025, thereafter, the Government has issued GO.Ms.No.01, Rural Development and Panchayat Raj (PR-1),dated

06.01.2025, by which Special Officers has been appointed. The district involved in the subject matter of this Writ Petition is Coimbatore and the term of the Panchyat President in the Coimbatore District got over on 05.01.2025.

4. Heard the learned counsel appearing on either sides and perused the records.

5. Considering the facts and circumstances of the case, this Court is not inclined to implead the Directorate of Vigilance and Anti Corruption as submitted by the learned counsel for the petitioner for the reason that the fourth respondent tenure got over on 05.01.2025 and the Special Officer has been appointed on 06.01.2025. The petitioner is at liberty to approach the Directorate of Vigilance and Anti Corruption, to take action against the fourth respondent.

6. With the above directions, this Writ Petition is disposed of. No

costs.
