2. In view of the contents of the affidavit, we accept that notice has been issued.

3. Respondent is absent though served. Therefore, the delay of seven days, for the reasons mentioned in the affidavit, is condoned.

4. Mr.Tamil states that the matter has been settled and once he receives confirmation from respondent or his clients, he will be even withdrawing the appeal.
