Suo Motu TR.No.18717 of 2025
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 06.10.2025
CORAM:
THE HONOURABLE MR. JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.No.18717 of 2025 (C.C.No.51 of 2023 of Judicial Magistrate Court, Harur Taluk, Dharmapuri) For Petitioner : Ms.G.V.Kasthuri Additional Public Prosecutor
ORDER
This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.
2. The case was registered in Cr.No.266 of 2010 for the alleged offence under Sections 143, 341, 353 of Indian Penal Code, 1860. The allegation in this case is that the accused have waylaid the Government officials and have seized the tractor along with sand. The other accused have already admitted the offence and paid the fine. As far as the present accused is concerned now only they are appearing.
3. Considering the factual matrix, context of the case, the antecedents of the accused and that the case is pending since 2010, it is evident that even if the accused are brought to face trial, it would impinge upon their right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.
