Today, the matter is listed under the caption "For Being Mentioned" at the instance of the learned counsel for the petitioner. 2.The learned counsel for petitioner would submit that in the above petition, the C.C.No. has been wrongly mentioned as 'C.C.No.29 of 2024' instead of 'C.C.No.29 of 2023'.
3.In view of the above submission, the 'C.C.No.29 of 2024' in the order dated 02.01.2025 shall be replaced as 'C.C.No.29 of 2023'. In all other respects, the order dated 02.01.2025, shall remain unaltered.
4. The Registry is directed to carry out the amendment and issue a fresh certified copy of the order, dated 02.01.2025. 09.01.2025 rsi Note: Issue order copy on 09.01.2025.

ORDER
This petition has been filed to exempt the petitioner from payment of fine amount in pursuance to the judgments dated 25.06.2024 made in C.C.No.29 of 2024 on the file of the learned Principal Special Court under EC & NDPS Act, Chennai, pending disposal of the Criminal Appeal. 3/6
2. Though this court had suspended the sentence imposed on the petitioner, it is reported by the learned counsel for the petitioner that the petitioner is still languishing in jail since he is unable to deposit the fine amount of Rs.1,70,000/-; that the petitioner is now aged 71 years and there are no previous cases; that he has no source of income to pay the fine amount and prayed for exemption of payment of fine amount.
3. Heard the learned Govt. Advocate (crl.side) appearing for the respondent.
4. Considering the age of the petitioner; the fact that there are no previous cases against the petitioner and the fact that inpsite of the order granting suspension of sentence, the petitioner has not been released for want of sufficient funds to pay the fine amount, this court is inclined to direct the petitioner to pay a sum of Rs.25,000/- towards fine instead of Rs.1,70,000/-. The learned Principal Special Judge for EC & NDPS Act cases, Chennai is directed to accept a sum of Rs.25,000/- towards fine amount and release the petitioner 4/6
on bail, subject to compliance of the earlier conditions imposed by this court while granting suspension of sentence.
