O R D E R
Petition seeking bail in Crime No.66 of 2022 registered on the file of the respondent for the offences under Section 392 IPC, is on board for consideration. 1/4
2. Learned counsel for the petitioner submits that the petitioner is an accused facing trial in C.C.No.259 of 2023 on the file of the learned Judicial Magistrate, Additional Mahila Court, Ariyalur. He further submits since the petitioner failed to appear before the trial court, the non bailable warrant was issued against him in the year 2023 and pursuant to the same, he was arrested on 10.07.2024. He also submits that subsequently, the petitioner was detained under Act 14 and on 30.09.2024, the detention order passed against the petitioner was revoked by the Advisory Board. He further submits that the petitioner undertakes that he will appear before the trial Court on all hearing dates without fail, he will cooperate for speedy disposal of the trial and he would cross examine the witnesses on their presence before the trial Court. Hence, he prayed for grant of bail to the petitioner.
3. Learned Government Advocate (Crl.Side) appearing for the respondent, while objecting for grant of bail, submits that the petitioner is a habitual offender, against whom, 44 previous cases registered at various police stations are pending. He further submits that as far as the present case is concerned, the petitioner was arrested under PT warrant on 10.07.2024 pursuant to the non-bailable warrant issued against him in C.C.No.259 of 2023. He further submits that the case is now ripe for trial and posted for examination of witnesses, therefore, if the petitioner is 2/4
enlarged on bail at this stage, there is every possibility of him absconding and derailing the progress of trial.
4. Having heard the learned counsel for the petitioner, the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record including the previous case details of the petitioner produced by the respondent and on considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
5. Accordingly, this Criminal Original Petition stands dismissed. However, the learned Government Advocate (Criminal Side) is directed to instruct all the Investigating Officers concerning the pending trial cases against the petitioner to produce the witnesses before the trial Court without fail. 24-01-2025 To
