Apprehending arrest in connection with Crime No.852 of 2024 registered for the offences punishable under Sections 296(b), 115(2), 118(1) and 351(3) of BNS, 2023, the present petition has been filed seeking anticipatory bail.
2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He further submits that false complaint has been given against the petitioner and he has been falsely implicated in this case. He further submits that there is no previous case is pending against him. He would submit that the petitioner is ready to abide by any stringent condition that may be imposed by this court.
3. The case of the prosecution, as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail, is that there was wordy quarrel between the petitioner & others and the de-facto complainant. He would further submit that the petitioner along with others had assaulted the de-facto complainant Page No.2 of 4
and they had used filthy language and threatened the de-facto complainant, due to which, the de-facto complainant got injured. He would further submit that 9 previous cases are pending against the petitioner herein. He would further submit that the investigation has been pending.
4. Considering the submissions made by the learned Government Advocate (Crl.Side), and considering that the investigation has been pending and considering that 9 previous cases are pending against the petitioner herein, at this stage, this Court is not inclined to grant anticipatory bail to the petitioner.
