ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offence u/s.148, 149, 452, 506(ii) of IPC r/w.3(1) of Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992. This occurrence was in the year 2008. When the school bus belonging to the defacto complainant hit a four year old child resulting in his death. All these accused said to have formed an unlawful assembly and caused destruction to the property of the school and hence the case has been registered. Upon contact, the defacto complainant is not expressing opinion one way or the other. Thus it can be seen that he is willing to close the case. Be that as it may when the occurrence is of the year 2008 and warrant is pending against the accused and it can be seen that many of the accused are in the advance age, even if the warrant is executed, the same will impinge upon the right to speedy trial.

3. Considering the over all nature of the case, only on the sudden outrage on account of death of the child, the said accused attacked the school and considering the huge efflux of time of seventeen years, I am of the view that this matter cannot be kept pending before the Magistrate any more.

4. Accordingly, the case in PRC.No.100035 of 2014 of Judicial Magistrate Court, Harur Taluk, Dharmapuri, stands quashed. This Suo Motu Transfer Case is disposed of.

06.10.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
