ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offence u/s.430, 397, 362, 395 of IPC, 1860. The stolen property has been recovered and handed over to the defacto complainant. The defacto complainant is not traceable. In respect of some of the accused the case was also committed and it is not even known as to what had happened to the committed case. It is stated that the records are also no more available. The case is pending from the year 1998. Even if the accused is identified and the warrant is executed, no useful purpose will be served in keeping the matter pending.

3. Accordingly, the case in PRC.No.100035 of 2004 of Judicial Magistrate Court, Harur Taluk, Dharmapuri, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
