No.618 of 2025. 2.These are two cases against the same accused, registered in Cr.No.46 of 2019 and 42 of 2019, both for the alleged offences under Section 379 of the I.P.C. The allegation in these cases are that the accused committed theft of bikes of the defacto complainant. It is reported that the said bikes have been recovered and handed over to the complainant. There is no previous or subsequent case against the accused. Defacto complainant does not want to proceed with the case any further.

sha 3.Considering the factual matrix, context of the case, the reason for absence from his usual place, and the submission that, despite best efforts, summons could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4.Accordingly, the cases in C.C.No.46 of 2020 & 87 of 2022 of Judicial Magistrate No.II, Hosur Taluk, Krishnagiri, stand quashed. These Suo Motu Transfer Cases are disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
