ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.4 of 2003 for the alleged offence under Section 4(i) and 19(i) of TNETA Act (RT) Order, 1984 r/w. 7(1)(a)(ii) of Essential Commodities Act 1955 and 468, 471 r/w.34 of IPC. The mother case in respect of A1 ended in acquittal in C.C.No.55 of 2007. Similarly, in respect of A5 and A9 also the case ended in acquittal in C.C.No.74 of 2017. This case is split up in respect of the other accused. The grounds for acquittal also apply to the accused. The matter has been pending at the stage of service of summon on the accused.

3.Considering the factual matrix, context of the case, the background of Page No.1 of 3

the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the summon could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon her right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4. Accordingly, the case in C.C.No.88 of 2024 of Principal District Munsif cum Judicial Magistrate Court, Gudalur Taluk, Nilgiris, stands quashed. This Suo Motu Transfer Case is disposed of. 16.10.2025 Vv electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
