Petition seeking bail in respect of Crime No.297 of 2015 registered for the offences punishable under Sections 450 & 392 of IPC and later altered into Sections 450, 392 & 397 of IPC, is on board for consideration. 1/4

2. The incarceration of the petitioner being from 09.10.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner is in no way connected with the alleged offence and he was remanded in this case through PT warrant. He further submits that the investigation in this case has been completed and the case has also been taken up on file, however, the petitioner is suffering incarceration for more than two months. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court

The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the accused trespassed into the house of the de facto complainant and robbed several sovereigns of gold jewels at knife point. He further submits that the charge sheet has been filed in this case and it has been taken up for trial on the file of the learned Judicial Magistrate No.II, Tindivanam in C.C.No.218 of 2016. He also submits that there are 13 witnesses in this case and the case now stands posted for appearance of the accused. He further submits that the petitioner is a habitual offender having 40 previous cases in Puducherry and 8 cases in Tamil Nadu. Therefore, if the petitioner is released on bail, there is every possibility of him absconding and not available for 2/4

trial proceedings.

Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the antecedents of the petitioner and that the case has also been taken up for trial, this court is not inclined to grant bail to the petitioner.
