ORDER

In a petition for rectification of a trade mark, the petitioner has presented this application for leave to lead secondary evidence in respect of documents described in Schedule-A to the Judge's summons. Schedule-A consists of about 13 documents. The justification for leading secondary evidence in respect of each document is contained in the table in ScheduleA. The affidavit also contains the reasons at paragraph 4 thereof.

2. Learned counsel for the first respondent submits that he has no objection to this application being allowed. He, however, submits that parties had agreed not to adduce oral evidence. In response, learned counsel for the applicant / petitioner states that he has been instructed to state that no oral evidence would be adduced in the matter.

3. In the above facts and circumstances, this application is allowed as prayed for.
