This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 16.09.2023 seeking bail in Crime No.382 of 2023 registered for the offence under Sections 302, 390 and 449 of IPC.

2. The case of the prosecution is that, due to previous enmity, petitioner attacked the deceased using knife, as a result of which, deceased sustained stab injuries and died. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person; that he has been falsely implicated in this case and that he is in custody from 16.09.2023 and since further custody is not required, the petitioner may be released on bail.

4. Learned Government Advocate (Crl.Side) reiterated the prosecution case and submitted that the petitioner has many previous cases. He further submitted that the trial in this case has commenced and it is likely to be completed within a period of two months.

5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.

6. Considering, the gravity of the offence, the stage of the trial and the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner at this stage. However, the petitioner cannot be incarcerated indefinitely during the trial. The trial Court shall therefore conclude the trial as expeditiously as possible. If the trial is not completed within a period of two months, the petitioner shall be at liberty to renew the bail application before the trial Court.
