ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case in C.C.No.45 of 2022 was taken on the file of the Judicial Magistrate Court, Rasipuram Taluk, Namakkal, for the alleged offence under Section 379 of I.P.C. The occurrence is said to have taken place on 06.10.2021. The accused committed theft of de-facto complainant's bike. It is reported that the property involved in this case has been recovered and handed over to the de-facto complainant, however the de-facto complainant is not traceable. It is reported that the accused has been attending the Court regularly. Apart from this case, one another case is pending against the accused.

3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2020, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served. 4.Accordingly, the case in C.C.No.45 of 2022 of Judicial Magistrate Court, Rasipuram Taluk, Namakkal, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
