ORDER

Apprehending arrest in connection with Crime No.38 of 2024 registered for the offences punishable under Sections 465 and 420 of IPC (BNS), the present petition has been filed by the petitioner seeking anticipatory bail.

The case of the prosecution is that the petitioner along with other accused who are employees of the defacto complainant had misappropriated the company amount of Rs.46,00,000/- and had cheated the defacto complainant. Hence the case.

3. Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is an innocent and that a false case has been fabricated against him. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court.

4. The learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner along with A2 had misappropriated the company funds to the tune of Rs.46,00,000/-. He further submitted that this Court had granted interim protection to the petitioner and directed to produce proof of payment to the company. However, the petitioner has not produced any proof. Arrested accused is still in custody.

Though this Court granted interim protection to the petitioner and directed to produce proof of payment to the company before this Court, the petitioner though he has appeared has not produced any proof to show the same.
