PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, pleased to direct the learned District Munsif at Attur to dispose of the suit in O.S.No.81 of 2015 the trial to be taken by day to day basis and fixed the stipulated time of period to be disposed.

ORDER

(Parties are referred to in the same ranking as before the trial court) Aggrieved by the fact that the suit filed by the first respondent/plaintiff in O.S.No.81 of 2015 has been pending all this while, that is from 28.04.2015. The defendants 1 and 7 seek an early disposal of the said suit. 2.The B diary extract would indicate that the suit had been posted in the list as early as 01.03.2018 and has been periodically adjourned. Thereafter, the 8th defendant had died and for taking steps in this regard, the matter had been pending since 29.06.2022. The interlocutory application for bringing on record the LR's had been allowed and it is being listed under caption for amendment since 19.12.2023. The Presiding Officer has not taken effective steps to ensure the amendment is carried out in the suit filed in the year 2015.

The suit has been filed for declaration and for permanent injunction. If the plaintiff is not coming forward to amend the plaint then the Presiding Officer shall take steps to ensure compliance.

dispose of the suit within a period of six months from the date of receipt of copy of this order. No costs.
