Prayer:- Civil Revision Petition is filed under Article 227 of the Constitution of India to pass an order directing the Hon'ble Debt Recovery Tribunal, Coimbatore to proceed with the above SARFAEISI APPEAL in S.A.No.537 of 2024 with further stages to complete the trial of the case within the time frame fixed by this Hon'be Court.

The above Civil Revision Petition is filed for an early disposal of SARFAEISI APPEAL in S.A.No.537 of 2024, pending on the file of the Debt Recovery Tribunal, Coimbatore.

2. Heard the learned counsel for the petitioner and perused the records.

3. A perusal of the B diary extract that has been produced would show that the SARFAEISI APPEAL in S.A.No.537 of 2024 has been pending since 18.07.2024 and the counter has also been filed [In IA.No.2340/2024 - seeking stay] by the Revision Petitioner Bank in August 2024 itself. The respondents are also enjoying the status quo in respect of the order dated 13.06.2024 passed by the Chief 2/4

Magistrate, Salem in CRL.MP.No.287/2024.

4. Considering the above, the Civil Revision Petition is allowed and a direction is issued to the Debt Recovery Tribunal, Coimbatore to dispose of SARFAEISI APPEAL in S.A.No.537 of 2024 within a period of 3 months from the date of receipt of a copy of the order. No costs.
