Petition seeking bail in respect of Crime No.387 of 2024 registered for the offences punishable under Section 64(1) of BNS, is on board for consideration. 1/4

2. The incarceration of the petitioner being from 27.11.2024 pleading innocence on the part of the petitioner and false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He also submits that the petitioner, aged about 60 years, who is the father-in-law of the de facto complainant, is in no way connected with the alleged offence, however, due to family dispute, a false complaint has been given against him. He further submits that even as per the First Information Report, the alleged occurrence taken place on 23.11.2024, whereas, the complaint was lodged only on 27.11.2024. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court

The case of the prosecution as putforth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner, who is the father-in-law of the de facto complainant had committed an offence against the de facto complainant under Section 64(1) of BNS. He further submits that the investigation in this case is still pending and the petitioner was also arrested very recently on 27.11.2024, therefore, if the petitioner is released on bail, there is every possibility of him absconding and not available for further investigation.

Having heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent Police and perused the materials available on record and considering the fact the petitioner was arrested very recently and that the investigation is also at nascent stage, this court is not inclined to grant bail to the petitioner.
