This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 41 days in filing the above Criminal Revision Case against the order dated 17.04.2025 passed in Crl.A.No. 623 of 2024 on the file of XVIII Addl. City Civil Court at Cehnnai and confirmed the order dated 24.06.2024 made in S.T.C.No.1412 of 2023, on the file of Metropolitan Magistrate Court, Egmore, Chennai.

Mr.V.T.Narendiran, learned counsel for petitioner submitted that due to misplace of bundle, the petitioner is not able to instruct counsel on record to prefer the above Criminal Revision case and after tracing out the bundle during month of September 2025, he gave papers to him, as a result of which, there is a delay of 41 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
