O R D E R
The petitioners were apprehend arrest at the hands of the respondent police for the offence punishable under Sections 21(1) of M.M (D&R) Act r/w Sections 303(2), 326(a) of BNS, Act, in Crime No.163 of 2025, on the file of the respondent Police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner, along with the other accused, had illegally transported four units of lake sand in four tractor-tipper vehicles, each containing one unit. Hence, the complaint.
3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and have been falsely implicated in this case. The petitioners are ready and willing to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of bail, reiterating the prosecution case and submitted that there are totally 4 accused in this case. 2/4
5. Heard the learned counsels on either side and perused the materials available on record.
6. Considering the gravity of the offence, the fact that the quantity and place where the lake sand was illegally quarried, this Court is not inclined to grant anticipatory bail to the petitioners.
