ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner seeking to Extension of time of the order dated 12.11.2024 in para 6(1) "the petitioner/accused is directed to deposit 20% on the cheque amount i.e., 1,75,400/- (Rupees one lakh seventy five thousand and four hundred only) within a period of four weeks from the date of receipt of a copy of this order" of this Hon'ble Court made Crl.M.P.No.15656 of 2024 in Crl.R.C.No.1918 of 2024 dated 12.11.2024.

When the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that this Court while granting suspension of sentence to the petitioner had directed the petitioner/accused to deposit 20% of the cheque amount i.e., Rs.1,75,400/- [Rupees One Lakh, Seventy Five Thousand and Four Hundred

Only], within a period of four weeks from the date of receipt of a copy of this order. He further submitted that the petitioner's father is dwelling in Vanur Taluk, Tindivanam, Villupuram District and he alone mobilize the funds to comply the order. Due to sudden cyclone, the entire agricultural lands are all submerged in water. The income yielded from that lands and all the cultivated crops are all damaged and the petitioner's father unable to mobilise the funds in time. Accordingly, he prays for extension of time to deposit the conditional amount.

In view of the submissions made by the learned counsel for the petitioner, this Court grants a further period of one week from today (04.07.2024) to the petitioner to deposit the conditional amount of 20% of the cheque amount on condition that the petitioner shall deposit another 40% of the cheque amount on or before 11.07.2024, failing which, the order of suspension already granted by this Court shall automatically stands cancelled and the concerned police is at liberty to take appropriate steps to secure the petitioner to undergo the remaining period of sentence as ordered by the Trial Court and confirmed by the Appellate Court.

Today the matter is listed under the caption 'for being mentioned' at the instance of the learned counsel for the petitioner.

2. The learned counsel for the petitioner has brought to the notice of this Court that a typographical error has crept in the fourth line of Paragraph No. 3 of the order dated 04.07.2025 passed in Crl.M.P.No.13066 of 2025 in Crl.R.C.No.1918 of 2024. The word "another" has been wrongly typed and requires deletion. He further prays for extension of time to deposit the conditional amount imposed by this Court.

Accepting the submissions of the learned counsel for the petitioner, the Registry is directed to delete the word "another" in the fourth line of Paragraph No.3 of the order dated 04.07.2025 passed in Crl.M.P.No.13066 of 2025 in Crl.R.C.No.1918 of 2024 and to carry out the necessary correction in the above said order and issue a fresh order copy.

4. Time is extended to the petitioner to comply with the condition imposed by this Court in Crl.M.P.No.13066 of 2025 in Crl.R.C.No.1918 of 2024 till 21.07.2025, failing which, the order passed therein shall stand automatically cancelled without further reference to this Court.
